Terms of purchase and sale

1. VALIDITY OF THE TERMS OF SALE

1) Terms of sale apply to the purchase of goods from the online store airfreshener.ee (registry code: 14170415, telephone: +372 5373 7741) between the buyer (hereinafter: buyer) and the company Tommi Trans OÜ (hereinafter: online store airfreshener.ee).

2) In addition to these terms and conditions, the legal relationship arising from the purchase of products from the online store airfreshener.ee is regulated by the Law of Obligations Act (hereinafter: VÕS), the Consumer Protection Act (hereinafter TKS) and other legislation in force in the Republic of Estonia.

3) The online store airfreshener.ee reserves the right to make changes in the terms of sale. These changes are reflected on the website www.airfreshener.ee.

2. PRICE INFORMATION

1) The goods are sent to Omniva or Itella Smartpost parcel machines based on the price list of the service provider. Goods that cannot be sent to the parcel machine are delivered to the buyer by courier. Read more about delivery in section 6 and under Delivery.

2) If the order was placed before the change in the terms of sale or the prices, the terms and conditions in force at the time of placing the order will apply to the legal relationship formed between the buyer and the online store airfreshener.ee.

3) The online store airfreshener.ee reserves the right to make changes in the sales prices. These changes are reflected on the website www.airfreshener.ee.

4) All prices are in euros.

3. METHODS OF PAYMENT

1) On the website of the online store airfreshener.ee, it is possible to pay by invoice.

2) All payments are made in euros and deducted from the buyer’s account in euros.

3) The online store is the controller of personal data.

4. PLACING AN ORDER

1) Add the desired products to the shopping cart.

2) To place the order, click on Go to checkout in the shopping cart.

3) On the checkout page, fill in the required data fields correctly, because the accuracy and correctness of the provided data are the basis for a fast and smooth delivery of the goods and the subsequent settlement of any possible disputes and claims. When registering a customer account, information regarding the registration will be sent to the provided e-mail address.

4) Confirm that you have read and agree to the Terms of Sale, and click on the dedicated button to place the order.

5) The invoice to be paid will be displayed. You can view your invoice at any time by logging in to your customer account. The invoice will also be sent to the e-mail address provided with the buyer’s data.

6) Orders placed in the online store are processed on working days (Mon–Fri between 10 am and 6 pm). If the order is placed after 3 pm on Friday, it will be processed on the following Monday.

5. ENTRY INTO FORCE OF THE SALES AGREEMENT

1) With the agreement for the sale of goods, the online store airfreshener.ee undertakes to transfer to the buyer the goods currently available or to be acquired by the online store airfreshener.ee in the future, and to enable the transfer of ownership to the buyer. The buyer undertakes to pay the online store airfreshener.ee for the goods in the amount indicated on the invoice and to accept the goods.

2) The sales agreement enters into force after the payment made by the buyer is received on the bank account of the online store airfreshener.ee.

6. DELIVERY

1) After entry into force of the sales agreement, the online store airfreshener.ee delivers the order to the buyer and hands it over to the company’s logistics partners for delivery. Delivery time is 3–5 days. In exceptional cases (national holidays, celebrations), the goods will reach the customer within 45 days at the latest.

2) The delivery times indicated on the website of the online store are valid from the moment the order amount is received on the bank account of the online store airfreshener.ee.

3) To avoid any delays in delivery, care must be taken, and true and valid data must be provided when placing the order.

4) The online store airfreshener.ee is not liable for any delay in the delivery of the goods if the goods have been handed over to the logistics partners on time and the delay in delivery is due to circumstances that the online store airfreshener.ee could not influence or foresee.

5) The goods are sent to the Cargobus terminal nearest to the buyer. Free delivery within Tartu.

The goods are delivered to the Cargobus terminal in Estonia indicated in the order by the buyer, delivery time 3–5 working days. The buyer will be notified of the arrival of goods to the indicated destination via a text message or e-mail.

7. RIGHT OF RETURN

1) After receiving the order, the buyer has the right to withdraw from the agreement concluded in the online store within 14 days. If the goods are defective or do not comply with the product description on the website of the online store airfreshener.ee, the withdrawal costs will be paid by the online store airfreshener.ee. In case of withdrawal from the agreement, the online store airfreshener.ee will pay the initial postage related to the return of the goods.

2) Upon receipt of the goods and before signing the accompanying document, the buyer must make sure that the packaging is intact. Later claims will not be satisfied. The returned goods must be unused, complete and in the original packaging, the packaging must not be broken or damaged. In order to ascertain the nature, characteristics and functioning of the item, the buyer must handle and use the goods only as they would normally do in a shop.

3) To return the goods, an application for withdrawal from the purchase of the goods must be submitted, which can be submitted in a free form and sent to the e-mail address info@airfreshener.ee no later than within 14 days of the receipt of the goods.

4) Immediately after submitting the application or no later than within 14 days thereof, the buyer must return the goods to the online store airfreshener.ee or present evidence that they have handed the goods over to a logistics company during the aforementioned period.

5) Upon receipt of the withdrawal application, the online store airfreshener.ee will return the amount paid for the goods to the buyer within 14 days at the latest.

8. FORCE MAJEURE

1) The online store airfreshener.ee is not liable for damages caused to the buyer or for the delay in the delivery of the goods if the damage or delay is due to circumstances which the online store airfreshener.ee could not influence or foresee.

9. PROCESSING OF PERSONAL DATA

The controller of personal data for the online store airfreshener.ee is Tommi Trans OÜ (registry code: 14170415, address: Anne 53-13, 50703 Tartu, telephone: +372 5373 7741, e-mail: info@airfreshener.ee).

What personal data is processed?

  • Name, telephone number and e-mail address;
  • delivery address for the goods;
  • bank account number;
  • cost of goods and services, and data related to payments (purchase history);
  • customer support information.

For what purpose is the personal data processed?

Personal data is used for managing the buyer’s orders and delivering the goods.

Purchase history data (purchase date, ordered goods, quantity, data of the buyer) is used to compile an overview of purchased goods and services and to analyse the buyer’s preferences.

The bank account number is used to return payments to the buyer.

Personal data (e-mail, telephone number, buyer’s name) are processed to resolve issues related to the goods and the provision of services (customer support).

The IP address or other network identifiers of the user of the online store airfreshener.ee are processed to provide the service of the online store as an information society and to compile online usage statistics.

Legal basis

Personal data is processed for the purpose of fulfilling the agreement entered into with the buyer.

The processing of personal data is carried out in order to fulfil legal obligations (e.g., accounting and settlement of consumer disputes).

Recipients to whom personal data is transferred

Personal data is transferred to the customer support of the online store airfreshener.ee to manage purchases and purchase history and to solve any issues of the buyer.

The name and telephone number will be forwarded to the transport service provider selected by the buyer and/or the supplier of the goods if the consignor is the supplier. If the goods are delivered by a courier or if the buyer orders the goods to a post office, the transferred contact details will include the buyer’s address.

If the accounting for the online store airfreshener.ee is organised by a service provider, the personal data will be transferred to the service provider for accounting purposes.

Personal data may be transferred to information technology service providers if this is necessary to ensure the functionality or data hosting of the online store.

Security and access to data

Personal data is stored on Zone.ee servers located in the territory of a Member State of the European Union or the countries that have joined the European Economic Area. Data may be transferred to countries whose level of data protection has been assessed as adequate by the European Commission and to companies that have joined the Privacy Shield framework.

Personal data can be accessed by the employees of the online store airfreshener.ee in order to resolve technical issues related to the use of the online store and to provide customer support services.

The online store airfreshener.ee implements appropriate physical, organisational and IT security measures to protect personal data from accidental or unlawful destruction, loss, alteration or unauthorised access and disclosure.

Transfer of personal data to the processors of the online store (e.g., transport service provider and data hosting) takes place on the basis of agreements concluded between the online store and the processors. Processors are obliged to ensure appropriate safeguards for the processing of personal data.

Access to and correction of personal data

Personal data can be accessed and corrections can be made to the user profile of the online store airfreshener.ee. If the purchase has been made without a user account, personal data can be accessed via customer support.

Withdrawal of consent

If the processing of personal data takes place with the buyer’s consent, the buyer has the right to withdraw their consent by notifying the customer support via e-mail.

Storage of personal data

When the customer account at the online store airfreshener.ee is closed, any personal data will be deleted, unless such data needs to be stored for accounting purposes or for resolving consumer disputes.

If the purchase in the online store has been made without a customer account, the purchase history will be stored for three years.

In case of issues related to payments and consumer disputes, personal data will be stored until the claim is fulfilled or until the end of the limitation period.

Personal data required for accounting purposes will be stored for seven years.

Deletion of personal data

To delete personal data, contact customer support by e-mail. A request for deletion will be replied to within a month at the latest, and the reply will specify the period for the deletion of data.

Transfer of personal data

A request for the transfer of personal data submitted by e-mail will be replied to within a month at the latest. Customer support verifies the identity of the buyer and notifies them of the personal data that is to be transferred.

Direct marketing messages

The e-mail address and telephone number will be used for sending direct marketing messages if the buyer has given their consent. If the buyer does not wish to receive direct marketing messages, they should select the appropriate link in the footer of the e-mail or contact customer support.

If personal data is processed for direct marketing purposes (profiling), the buyer has the right to object at any time to the initial and any further processing of their personal data, including for the direct marketing profiling, by notifying customer support by e-mail. This information must be presented clearly and separately from any other information.

Settlement of disputes

Disputes related to the processing of personal data are resolved through customer support (e-mail: info@airfreshener.ee). The supervisory authority is the Estonian Data Protection Inspectorate (info@aki.ee).

10. PROCEDURE FOR SUBMITTING CLAIMS

1) According to subsection 218 (2) of the VÕS, the products sold at the online store airfreshener.ee are subject to a 2-year term for submitting claims.

2) In the event of a defect, the buyer must submit a claim to the online store airfreshener.ee no later than within two months of the occurrence of the defect, attaching a digital or paper invoice on the basis of which the purchase of the goods was paid for.

3) The online store airfreshener.ee is not liable for

– defects in the product caused by the buyer resulting from non-compliance with the instructions for use of the product, incorrect or improper use and storage of the product,

– normal wear and tear of the product.

4) In case of non-compliance of the product or an occurrence of defects, the buyer will send to the e-mail address info@airfreshener.ee a claim stating the name of the person who placed the order, a contact telephone number, order number and a precise description of the non-compliance or defect of the product.

5) All claims will be reviewed and the buyer will be contacted as soon as possible, but not later than within 14 days of receiving the claim.

11. RIGHT OF THE BUYER TO ACCESS THE EUROPEAN UNION CONSUMER DISPUTE RESOLUTION PLATFORM

1) If the buyer has complaints regarding the online store airfreshener.ee, they should be sent to the e-mail address info@airfreshener.ee.

2) If the buyer and the online store airfreshener.ee are unable to resolve the dispute by agreement, the buyer can turn to the Consumer Disputes Committee. The procedural conditions can be viewed and the application submitted HERE. The Consumer Disputes Committee is competent to resolve disputes arising from the agreement concluded between the buyer and the online store airfreshener.ee. The committee reviews the buyer’s complaint free of charge.

3) The buyer can access the European Union online dispute resolution platform.
